Neil Kelley
Neil worked in the City and overseas for his City practice before working in Tunbridge Wells and then commencing work from our Sevenoaks office. Neil specializes in the field of dispute resolution in its many forms. Commercial & Business We can offer a broad experience in respect of commercial disputes. This includes disputes arising out of contractual and partnership agreements, shareholder agreements and any matter relating to company and commercial law in general. Non-Payment of Invoices & Debt Recovery We can act for claimants and defendants in this capacity. If you have issued an invoice and have not been paid we can generally bring the matter to a satisfactory conclusion. A party will often pay upon receipt of a solicitor's letter. In the event they do not, we can advise you in respect of the appropriate court action and issues involving statutory declarations and bankrupting non-payers. If you are an individual or company being chased to pay an invoice which is in dispute, we can advise in respect of the correct tactics to adopt. The important issue in these circumstances is not to delay. Any delay will frequently result in the matter becoming more complex and thus expensive. Construction We have broad experience in respect of construction disputes. This ranges from small domestic construction disputes between an individual homeowner and their builder or the NHBC to disputes between contractors and subcontractors, contractual and statutory adjudication, major international arbitration and high value, international construction disputes involving anything from a coin minting facility to a port development. Landlord and Tenant We act for landlords, freeholders and leaseholders in all sorts of disputes. Most of our work tends to be for landlords and we deal with such issues as non-payment of rent, possession claims, claims arising out of the sale of freehold interests, disputes involving tenant's associations and leasehold obligations. This is an extremely broad area of law and it is not possible to cover all of the possible areas exhaustively. Employment We represent both claimants and respondents in respect of claims including unfair and constructive dismissal and general labour disputes. Many of these issues can be settled by negotiation and a compromise agreement reached. Where this is not possible we can act for you and guide you through the employment tribunal process. Personal Injury Claims We act for both claimants and defendants. Insurance Disputes We can advise and represent you in respect of all claims under policies of insurance. We act exclusively for the insured and do not act for insurance companies, thus avoiding the potential conflict which can often arise. If you are having difficulty with a claim under a policy of insurance you should contact us. It is often easier for a solicitor to negotiate a better settlement on your behalf rather than trying to do so yourself. Shipping & International Trade We have extensive experience in this area of law. We can act for ship owners, charterers, cargo interests and freight forwarders. We have experience of claims including loss of ships and cargo following fire, explosion and collision. We have experience of representing ship owners and charterers in salvage claims and ship owners and charterers in claims arising under time, voyage and bareboat charter parties. We also have experience of representing yacht owners in general disputes relating to their yachts and disputes with insurers in respect of claims under policies of marine Insurance. Criminal Law We undertake matters relating to allegations of white collar crime against our clients. These matters are privately funded. We do not do legally aided matters. Family Law We do not deal with family law disputes but know a firm that does! If you are looking for a recommendation please give us a call. If you have any dispute resolution queries you should speak to our Neil Kelley. Further Information |
